Performance Pistol and Rifle – Registration & Waiver

Read carefully before signing, this is a legal release of liability and waiver of certain legal rights.

ASSUMPTION OF RISK

I acknowledge and understand that participating in live-fire firearms activities involves inherent risks and expressly assume such risks which include, but are not limited to:

Discharge of firearms by myself or others
Exposure to loud noise, hot brass, lead, and other hazardous materials
Malfunction of firearms or ammunition
Slips, trips, falls, or other accidents on the premises
Serious injury or death

SAFETY RULES

I agree to comply with all safety rules and follow the instructions of staff and range instructors, including, but not limited to:

Always keep the firearm pointed in a safe direction.
Always keep your finger off the trigger until ready to fire.
Always keep the firearm unloaded until instructed otherwise.
Wear required eye and ear protection at all times.
Immediately follow all commands given by staff.

Failure to follow safety rules may result in my removal from the event without refund.

RELEASE OF LIABILITY

I agree to release, hold harmless, and defend TAG Firearms LLC (“TAG”), and any of its employees, directors, officers, agents, volunteers, event organizers, sponsors, and all other persons or entities (hereinafter “Released Parties”), from any and all fault, liabilities, costs, expenses, claims, demands, or lawsuits arising out of or connected with: the discharge of a firearm, the course of instruction, designated range, building, land, and premises (hereinafter “Premises”), and my presence and/or use of said Premises. This includes any cause of action arising from my participation, whether caused by negligence or otherwise, including, but not limited to, claims for personal injury, illness, property damage, or wrongful death.

INDEMNIFICATION

Should any such claim, demand, or lawsuit arise or be asserted, whether under the laws of the United States, North Dakota, or any theory of law or equity, I agree to indemnify, hold harmless, and defend TAG from any and all costs, expenses, or liability including, but not limited to, the cost of any settlement or judgment made or rendered against TAG, whether individually or jointly, together with all costs of court and other costs or expenses incurred in connection with any such claim, demand or lawsuit, including attorney’s fees.

I further waive for myself as well as my executors, administrators, assignees or heirs, any and all rights and claims for damages, losses, demands and any other actions whatsoever, which they may have or which may arise against TAG (including, but not limited to, any and all injuries, damages, or illnesses suffered by me or affecting my property), which may, in any way, arise out of or relate to: the course of instruction; the Premises, including any latent defect in the Premises; my property (whether or not entrusted to TAG); and, the discharge of firearms. TAG shall not be liable and I, on behalf of myself and my executors, administrators, assignees, or heirs, hereby expressly release TAG from any and all such claims.

MEDICAL TREATMENT

In the event of an injury or medical emergency, I consent to receive medical treatment deemed necessary by event staff or emergency personnel and agree to be financially responsible for any costs incurred.

PHOTOGRAPHY & MEDIA RELEASE

I understand that photographs and/or videos may be taken during the event and hereby agree that TAG may use such photographs and videos of me with or without my name and for any lawful purpose, including, but not limited to, publicity, illustration, advertising, and web content.

LEGAL AGE & COMPETENCY

I affirm that I am:

1. At least 18 years of age AND I am not prohibited by federal, state, or local law from possessing or handling firearms; OR

2. Under the age of 18 and my parent/legal guardian is required to sign this form on my behalf.

GOVERNING LAW

This agreement shall be governed by the laws of the State of North Dakota, and any legal action shall be filed in the courts of Burleigh County, ND
